Legal

Terms and
conditions.

The rules we both work to. Written plainly so there are no surprises later, and short enough that you might actually read it. Your written quote always takes priority over anything on this page.

Who these terms are between

These terms are between you, the client, and Brandstralia (legal entity name: Brandstralia), a web design and digital marketing business based in Sydney, Australia.

They apply to every project and monthly service unless your written quote or agreement says something different. Where the two disagree, the quote wins.

Using this website

The information on this website is general and is not advice for your specific business. Results from our free website audit come from automated tests and are a guide only, not a guarantee. You may not copy our designs, content or code, or use the site or its forms to send spam or harmful material.

Quotes and acceptance

Quotes are fixed for the work described and valid for 30 days. A project is confirmed once you accept the quote in writing, including by email, and pay the deposit.

Anything not listed in the quote is not included. That is not us being difficult, it is how we keep the price fixed.

Prices and GST

All prices are in Australian dollars. GST is added where it applies, and your quote shows whether it is included.

Payment

Unless your quote says otherwise, we invoice 50% up front and the balance when the work is complete and before the site goes live. Larger projects may be split into stages.

Invoices are due within 7 days. Monthly services such as maintenance, social media and SEO are billed in advance each month.

If an invoice is overdue we will remind you first. If it stays unpaid we may pause the work, and the site will not go live, until it is paid. Final files and full ownership are handed over once the final invoice is paid.

Ongoing costs you pay directly

Domain names, hosting, premium plugins, themes, fonts, stock images, email and other subscriptions are billed by those providers, usually yearly. They stay in your name and you are responsible for renewing them. We will tell you which ones your site needs before we start.

What we need from you

Projects stall on content far more often than on code. We need your text, images, logos and logins within a reasonable time of asking, and one person who can give feedback and sign things off.

If a project goes quiet for more than 60 days, we may close it and invoice for the work done up to that point. Delays in content, feedback or third party access move the launch date, not the price.

Your content

You confirm that you own, or have permission to use, the text, images, logos and other material you give us, and that it is accurate and lawful. You are responsible for the claims your business makes on its own website, and for having your own privacy policy and terms.

Changes and revisions

Your quote includes 2 rounds of revisions on the design. We would rather get it right, so if a change is small we usually just do it.

Changes that add pages, features or a new direction are quoted separately and only start once you approve them. You will never get a surprise invoice.

Approval and launch

Before launch we show you the finished site on a private link. Once you approve it, or start using it publicly, it is treated as accepted. Anything that is not working as agreed after that is covered by the support period below.

Ownership

Once your final invoice is paid, you own the website, its content and the design we made for you. Your domain, hosting and accounts stay in your name throughout.

We keep ownership of our own tools, code snippets, templates and processes, and you get a permanent licence to use any of them that are part of your site. Plugins, themes, fonts, stock images and other third party items stay under their own licences.

Unless you ask us not to, we may show the finished work in our portfolio and on social media.

Third party services

Websites rely on things we do not control, such as hosting, plugins, payment providers, booking systems, social media platforms and Google. We choose reputable ones and set them up properly, but we are not responsible for their outages, price changes, policy changes or decisions.

AI tools

We may use AI tools to help with copy, images, code and automation. A person reviews everything before it reaches you, and we do not share your confidential information with these tools beyond what the work needs.

Support after launch

Every website project includes 30 days of support after launch for anything that is not working as agreed. That is bug fixing, not new work.

After that, fixes and changes can be done as individual jobs or through a maintenance plan. WordPress needs regular updates and backups whichever you choose, and sites that are left alone eventually break.

Security and backups

We build with security in mind, but no website can be guaranteed against hacking, malware or data loss. Unless you are on one of our maintenance plans, updates, backups and security are your responsibility after the support period. We strongly recommend you keep your own backups as well.

What we do not promise

We cannot promise specific rankings, traffic numbers, sales, leads or followers, because they depend on your market, your prices, your competitors and the platforms themselves. Anyone who does promise those is guessing.

What we do promise is that the work will be done with care and skill, on the agreed scope, and that we will tell you the truth about what is and is not working.

Your rights under Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms removes or limits those rights.

Liability

Beyond the rights above, and to the extent the law allows, our total liability for any claim is limited to the amount you paid us for the work the claim relates to. Where the law allows, we may meet that liability by redoing the work or refunding what you paid for it.

We are not liable for indirect losses such as lost profit, lost data or lost business, or for problems caused by changes made by you or someone else, third party services, or events beyond our reasonable control.

Ending a project or service

You can stop a project at any time by telling us in writing. We will invoice for the work done to that point and hand over what has been paid for.

Monthly services can be cancelled with 30 days written notice on either side. There are no lock in contracts and no exit fees.

We may end a project if an invoice stays unpaid, if we are asked to do something unlawful, or if communication becomes abusive. If that happens you pay only for the work done.

Confidentiality

Anything you share with us about your business stays between us, and we are happy to sign your NDA. We expect the same for our quotes and processes.

Privacy

How we handle personal information is explained in our Privacy Policy.

Changes to these terms

We may update these terms from time to time. The date at the top of this page shows when they last changed. Work already quoted continues under the terms that applied when you accepted the quote.

Disputes and governing law

If something goes wrong, tell us first and we will try to sort it out by talking, because that is faster and cheaper for everyone. If we cannot agree within 30 days, either of us can suggest mediation before going to court.

These terms are governed by the laws of New South Wales, Australia, and the courts of New South Wales can hear any dispute.

Not sure about something?

Let's talk.

Want any of these terms explained before you sign off on a quote? Ask us and we will talk it through.
